The Draft Law on Handling of Administrative violations

To conform with the guidelines of the Party on judicial and state apparatus reform in the process of building the socialist rule- of- law State, the Draft Law on Handling of Administrative Violations needed to judicialize the application of other administrative handling measures. This is also the common opinion of evaluation council on the Draft Law on Handling of Administrative Violations in their meeting held on June 8 under the chairman of the President of the Council - Deputy Minister of Justice Dinh Trung Tung.
Apart from administrative probation measure that was abolished in 2007 (Ordinance No. 31/2007/PL-UBTVQH11 amend some articles of the Ordinance on Handling of Administrative Sanctions 2002), there are still four other administrative handling measures stipulated in the current Ordinance including: education at communes, wards, district towns; sending to reformatories; sending to education establishments; and sending to medical treatment establishments.

In the process of building the Draft Law on Handling of Administrative Violations, the compiling committee proposed to abolish the measure of sending to medical treatment establishments as this is the appropriate time to ensure the consistency in the legal system dealing with acts of drug use as well as ensuring the effectiveness of the education and mending for prostitutes.

However, delegates do not agree with each other on the proposal that the district People's Courts shall be assigned to apply the measures of sending to reformatories and education establishments.

Speaking at the meeting, Deputy Minister Dinh Trung Tung agreed to assign district People's Courts to consider the application of administrative handling measures of sending to reformatories and education establishments./.-ITD
