Decision prescribing the functions, duties, powers and organizational structure of the Department of judicial administration

Justice Minister issued Decision No 97/ QD-BTP dated 26/ 01/ 2011 prescribing the functions, duties, powers and organizational structure of the National Center for judicial records. Persuant to this Decision, the judicial administration Department’s functions and duties assisting the Minister of Justice in undertaking the State management over the field of judicial records ( stipulated in the Decision 305/QD-BTP dated 05/02/2009) were handed over to the National Center for judicial records from 26/01/ 2011.
To assure the integrated implementation of the  the functions, duties, powers and organizational structure of departments under Ministry of Justice, Justice Minister on 24/03/ 2011signed and issued the Decision No 374/ QD-BTP prescribing the functions, duties, powers and organizational structure of Department of judicial administration.

This decision based on the Decision 305/QD-BTP dated 05/02/2009 of the Minister of Justice prescribing the functions, duties, powers and organizational structure of the Department of Judicial Administration, amending and supplementing some articles as follow:

* About the function of the department: The first article stipulates that the Department of Judicial Administration is an organization attached to the Ministry of Justice that has functions to assist the Minister of Justice in undertaking the State management over the field of judicial administration including civil status, nationality and certification. Therefore, comparing with Decision 305/QD-BTP, the function assisting the Minister of Justice in undertaking the State management over the field of judicial records is no longer in charge of Department of judicial administration and is now undertaken by the National Center for judicial records pursuant to Decision No 97/ QD-BTP.

* About duties and powers of the department: Based on the assigned function, the Decision stipulates the detailed duties and powers of Department of judicial administration in the fields of judicial administration including civil status, nationality and certification. The Decision does not stipulate the duties and powers of the Department in the field of national records.

* About the organizational structure of the department: the decision basically remains the organizational structure of the Department as present, except from changing Division of judicial record management and certification into the Division of certification management.

The Decision also supplements some points relating to the duties, powers and relations between the Department and other departments under Ministry of Justice.

The Decision comes into effect since the signing date and replaces Decision 305/QD-BTP dated 05/02/2009 of the Minister of Justice prescribing the functions, duties, powers and organizational structure of the Department of Judicial Administration./.-ITD
