Ministry of Justice should continue to "stand out" in providing legal support for enterprises

On 11 May, Minister of Justice Le Thanh Long chaired a meeting on the organization and implementation of the interdisciplinary legal aid Program for enterprises (Program 585). Attending the meeting were Deputy Minister Phan Chi Hieu, members of the Program Management Board who are leaders of units under the Ministry and officers participating part-time in the Program

Reporting to the leaders of the Ministry on the Program’s activities over the past years, Mr. Tran Minh Son said the Program has paid attention to conducting survey on enterprises’ opinions, understanding their demand for learning specialized areas of law. Beside, the Program has issued a number of newsletters on Legal support for enterprises towards proper beneficiaries and developed a network of consultants for enterprises by mobilizing jurists and lawyers in consulting directly or in written. Since then, there have emerged 03 useful activities, namely: legal dissemination for enterprises on the VOV and VTV, dialogue and support for small and medium enterprises.
Besides such positive results, Mr. Nguyen Hong Tuyen, Director General of Department of General affairs on legislative development, Deputy Chief of the Program Management Board also shared several difficulties and shortcomings during the implementation of the Program. Accordingly, it is necessary to change the model of the Program in the coming time, including the needs of strenthening staff and organization, having specialized officers, renovating the office work of the Program. Furthermore, the activities of the Program should be connected effectively with the activities of Legal Club for Enterprises as well as legal departments of ministries, sectors and enterprises.
Mr. Nguyen Thanh Tu, Director General of Department of Economic – Civil Legislation, also stated that comparing to many other programs, the financial fund of the Program is limited yet its positive effects upon enterprises have been regconized by independent assessment. According to Mr. Tu, however, there still remains a question that whether the Program should be fully assigned to an unit under the Minitry so that this unit can mobilize more participants for the Program. Moreover, the legal dissermination program on VTV and VOV should be renovated and further improved in the coming time. Mr. Tu hoped that the dialogue between the Ministry’s leaders and enterprises about current issues of Viet Nam relating to the Ministry of Justice and judicial sector will be developed this year.
Deputy Director of the Department of International Law, Mr. Nguyen Duc Kien addressed: the Ministry of Justice has been standing out in Program 585. Especially, the Law and Bussiness program on radio and television has made the Program widely known. This program reviews and discusses difficulties during the implementation of laws in practice that are matters of concern of enterprises and society. However, legal support for enterprise must be distinguished from legal aid as the former is not just simply about training and providing information to the enterprises. In addition, the dialogue activities should be implemented effectively and refrain from overlapping with those carried out by other ministries, Mr. Kien said.
Addressing the current context that the Government are very interested in enterprises, Deputy Minister Phan Chi Hieu considered Program 585 as an advantage of the judicial sector. However, the Program has not been fully utilized yet over the past years. One of the main reasons causing to this matter is the expenditure for the Program still remains modest so it cannot attract specialists and is in short of professional staff to undertake the Program. Discussing the shortcomings of the Program, the Deputy Minister stated that it is necessary to develop the habit of using legal support for enterprises and it should be considered as a “highway” promoting development. On that basis, the Deputy Minister proposed to concentrate on responding to the Government’s policy on being a start-up nation, promoting the network of consultants to directly support enterprises in localities, undertaking effectively the legal dissemination program on radio and television and connecting with units under the Ministry to increase the practical value of the outcome. The Deputy Minister also hoped that the Minister would allow to establish a specialized office to create favourable conditions for the implementation of the Program.
Praising the efforts of officers participating in Program 585 in overcoming difficulties to obtain certain results, Minister Le Thanh Long sincerely pointed out several drawbacks of the Program and noted that some activities were still scattered. According to the Minister, we should set out activities in 2 years 2017 – 2018 firstly and prepare carefully a plan to accelerate the annual activities of the Program in the long run. The Minister asked for further research on whether individual household business is a beneficiary of the Program to develop the habit of using legal support. Agreeing that the available results of the Program must be shared with units under the Ministry, the Minister requested the Program to coordinate with the Department of Ogarnization and personnel on strengthening the organization to meet the requirements of  cutting the intermediate stage, applying a more flexible mechanism to encourage the officers to carry out the Program.
