Ministry of Justice Inspectorate
In accordance with Minister of Justice's Decision No. 285/QD-BTP of February 13th, 2018 defining the functions, tasks, powers and organizational structures of the Ministry of Justice Inspectorate, the Ministry of Justice Inspectorate has the following functions, tasks, powers and organizational structures: I. Functions - 1. The Ministry of Justice Inspectorate is a unit of the Ministry with the functions of assisting the Minister with State administration of inspection, denunciation and complaint settlement, anti-corruption of the Ministry's scope of State administration; carrying out administrative and specialized inspection; settling denunciation, complaint and corruption in accordance with law and as assigned by the Ministry.
- 2. The Ministry of Justice Inspectorate (hereinafter refer to as Ministry Inspectorate) has separate seal and account at the State Treasurery in accordance with law.
II. Tasks and powers The Ministry Inspectorate has the following tasks and powers: - 1. Formulating and submitting to the Minister long term, five-year and annual work plan to the Minister; participating in drafting long term, five-year and annual strategy, scheme and plan of the Legal branch.
- 2. Leading or participating in drafting legal normative documents relating to organization and operation of Legal inspectorates, programs, schemes, plans regarding inspectorate, citizen reception, complaints and denunciation settlement, anti-corruption, within the Ministry's scope of State administration and submitting to the Minster or other authorized agencies to promulgate; participating in drafting, appraising, commenting on other projects and documents as assigned by the Minister.
- 3. Implementing legal normative documents, schemes, programs, plans regarding inspectorate, citizen reception, denunciation and complaint settlement and anti-corruption within the Ministry's scope of State administration.
- 4. Reviewing, systemizing and consolidating legal normative documents regarding inspectorate, citizen reception, denunciation and complaint settlement and anti-corruption within the Ministry's scope of State administration in accordance with law.
- 5. Inspecting the implementation of policy, law, tasks and powers of agencies, individuals and organizations of the Ministry's direct management (administrative inspection).
- 6. Inspecting implementation of specialized legislation, technical regulation and management rules of agencies, individuals and organizations of the Ministry's scope of State administration (specialized inspection).
- 7. Carrying out inspection when there is sign of violations from agencies, individuals and organizations of the Ministry's direct management; clarifying and settling denunciation and complaint or assisting the Minister's State administration work.
- 8. Assisting, monitoring, reviewing the formulation and implementation of inspectorate plan under the responsibility of the Department of Judicial Assistance and the Department of Civil Status, Nationality and Certification; providing technical assistance and training in accordance with law and as assigned by the Ministry.
- 9. Reviewing the accuracy and lawfulness of inspectorate decisions and post inspectorate decisions of Director of Department of Judicial Assistance and Director of Department of Civil Status, Nationality and Certification and Chairman of Provincial People's Committee regarding cases within the Ministry's scope of State administration in accordance with law.
- 10. Re-inspecting cases with signs of violations which have already been concluded by Director of Department of Judicial Assistance and Director of Department of Civil Status, Nationality and Certification and Chairman of Provincial People's Committee as assigned by the Minister.
- 11. Leading or participating in interdisciplinary inspection team organized by other Ministries and agencies; requesting officials from relevant Ministries and agencies to participate in inspection team in accordance with law.
- 12. Assisting and reviewing units of the Ministry regarding inspectorate, citizen reception, denunciation and complaint settlement and anti-corruption works; monitoring, reviewing and requesting units of the Ministry to handle denunciations, complaints and to implement the Minister and other heads of Departments' complaint and denunciation conclusions.
- 13. Carrying out inspectorate, citizen reception, denunciation and complaint settlement and anti-corruption work; leading and cooperating with other units of the Ministry to propose solutions for denunciations and complaints cases within the Minister's responsibility in accordance with law and as assigned by the Ministry.
- 14. Sanctioning administrative violations according to laws on administrative violation sanction.
- 15. Proposing competent state agencies to suspend or annul unlawful regulations discovered though inspection.
- 16. Monitoring and reviewing the implementation of inspectorate conclusions, decisions and proposals of the Minister of Justice and Chief Inspector in accordance with law.
- 17. Monitoring the status, implementation results and proposing competent state agencies to supplement and amend the guidelines, policies and measures, legal normative documents regarding to inspection, citizen reception, complaint and denunciation settlement and anti-corruption within the Ministry's scope of State administration.
- 18. Organizing interim, final review, reporting and archiving inspection, citizen reception, complaint and denunciation settlement and anti-corruption work in accordance with law.
- 19. Participating in scientific research, staff education and training; using inspection, citizen reception, complaint and denunciation settlement and anti-corruption website under the Inspectorate's scope of responsibilities and as assigned by the Ministry.
- 20. Applying information technology in inspection, citizen reception, complaint and denunciation settlement and anti-corruption activities.
- 21.Carrying out emulation and commendation, Inspectorate staff management work in accordance with law and as assigned by the Ministry.
- 22. Carrying out international cooperation regarding inspection, citizen reception, complaint and denunciation settlement and anti-corruption in accordance with law and as assigned by the Ministry.
- 23.Carrying out financial and accounting schemes, fund and asset management of the Inspectorate in accordance with law.
- 24. Carrying out other tasks and powers as assigned by the Minister or in accordance with law.
