The Department of Organization and Personnel

Pursuant to Decision No. 3069/QD-BTP dated 17 November 2014 of the Minister of Justice prescribing the functions, duties, powers and organizational structure of the Department of Organization and Personnel, the Department has functions, duties, powers and organizational structure as follows:

I. Role and functions

The Department of Organization and Personnel is a unit under the Ministry of Justice (hereafter called "the Department") which performs the advisory function to the Minister in state management over organizational apparatus, payroll, servants, officials, public employees and (herein after referred to as personnel); training and fostering for Ministry and the Justice sector's personnel according to provisions of laws.

II. Tasks and powers

1. Formulating and submitting long-term, five-year and annual work plans of the Department to the Minister; taking part in formulating strategies, master plans and plans of the Justice sector for long-term, five-year and yearly periods.

2. Developing and submitting strategies, projects and plans for state management of organizational apparatus, payroll, personnel, training and fostering under the scope of management of the Ministry.

3. Taking prime responsibility for and coordinating with other agencies in developing draft projects and legal normative documents on organizational apparatus, payroll, personnel, training and fostering of the Ministry and the Justice sector to submit to the Minister or other competent agencies for approval; participating in developing, making comments and appraising other draft projects and legal normative documents as assigned by the Minister.

4. Organizing the implementation of approved plans, strategies, programs and projects of legal normative documents under the scope of the Department.

5. Regarding organizational structure:

a) Proposing method and solutions to consolidate the personnel of the Justice sector;

b) Appraising and submitting draft decisions of the Minister of Justice prescribing the functions, duties, powers and organizational structure of units under the Ministry; draft decisions to set up, re-organize and dissolve agencies under the Ministry to the Minister according to laws and as delegated by the Minister; appraising draft projects and legal normative documents consolidating functions, tasks and organizational structure of agencies under the Ministry;

c) Guiding, monitoring and following up with agencies under the Ministry on their tasks of developing and implementing provisions on their functions, duties, powers and organizational structure.

6. Regarding professional positions and payroll:

a) Guiding the development and appraising professional positions and submitting to the Minister to decide to forward to the Ministry of Home Affairs for consideration and approval; managing professional positions of units under the Ministry according to provisions of laws and delegation of the Ministry;

b) Guiding the development of plan of the number of officials and public employees of units under the Ministry; synthetizing and developing plan of the number of officials and public employees and submitting to the Minister or other competent agencies for decision according to provisions of laws;

c) Submitting allocation of annual payroll for the units assisting the Minister in performing the state management, payroll and the number of public employees in public service units under the Ministry and public service units under the Department of the Ministry to the Minister to decide according provisions of laws.

7. Regarding the personnel:

a) Taking prime responsibility for and coordinating with other agencies of the Ministry in developing and submitting promulgation of professional criteria of specialized official's ranks in the Justice sector to the Minister for suggesting to the Minister of Home Affairs for approval; developing and submitting specific professional criteria of Director and Deputy Director of the Justice Departments to the Minister for approval; supervising the implementation of such criteria;

b) Organizing the implementation of the recruitment, rank appointment, rank promotion, rank shift, salary rise; personnel master plans; appointment and re-appointment, rotation, relief from leading post, resignation; retirement, job discontinuation; transfer, seconding; evaluation of personnel; enumeration of property and income; management of personnel files and social insurance dossiers; disciplining; settlement of complaints and denunciations, and other regimes and policies towards personnel according to the provisions of law and delegation of the Ministry;

c) Submitting to the Minister for decision of selection and sending of personnel to study domestically and abroad; permitting personnel of units under the Ministry to go abroad for private purposes according to provisions of laws and delegation of the Ministry;

d) Coordinating with General Department of Civil Judgment Enforcement in managing and supervising the organizational structure and personnel of the Civil Judgment Enforcement agency system according to provisions of laws and delegation of the Ministry.

8. Regarding training and fostering:

a) Taking prime responsibility for or coordinating with relevant organizations in making plan and allocating annual training and fostering funds; guiding, examining and urging units under the Ministry to implement the training and fostering of their personnel according to the approved master plans and schemes;

b) Taking prime responsibility for and coordinating with other agencies of the Ministry in compiling and evaluating professional training and fostering programs and materials within the Ministry's competence;

c)  Taking prime responsibility for or coordinating with relevant organizations in organizing professional training courses for personnel of organizations under the Ministry of Justice, legal organizations of other ministries and sectors, and local justice agencies;

d) Assisting the Minister in administering the Hanoi Law University, the Judicial Academy, Law Junior Colleges and other training establishments under the Ministry according to provisions of laws and delegation of the Ministry.

9. Acting as the focal point to coordinate with other units of the Ministry to monitor operations of associations operating within the scope of state management of the Ministry.

10. Assisting the Minister in managing youth work of the Ministry in accordance with the law.

11. Monitoring organizational apparatus, payroll, personnel, training and fostering of local judicial agencies; coordinating with other relevant agencies to monitor and make reports on organizations and personnel of the Justice sector.

12. Undertaking the work of internal political protection and legal provisions on the State secrets in the field of organization and personnel according to provisions of laws.

13. Assisting the Party Civil Affairs Committee of the Ministry of Justice in its operation; and playing the role of standing Committee for the Advancement of Women in the Justice sector.

14. Managing and exploiting databases on organizational apparatus, payroll, personnel, training and fostering; applying IT in state management of organizational apparatus, payroll, personnel, training and fostering according to provisions of laws.

15. Conducting interim and final reviews and report on a periodical or ad-hoc basis on the areas and tasks falling within the scope of management of the Department according to provisions of laws.

16. Examining and involving in inspection of the implementation of provisions on organizational apparatus, payroll, personnel, training and fostering of the Ministry; taking part in settlement of complaints and denunciations,  performing combat and prevention of corruption, negative issues and violations according to provisions of laws and as delegated by the Ministry.

17. Taking part in conducting research, legal education and dissemination under the scope of management of the Department;

18. Implementing the activity of competition - reward and managing officials and assets according to provisions of laws and as delegated by the Ministry.

19. Fulfilling other duties as assigned by the Minister.
