The Department of Legal Dissemination and Education
In accordance with the Minister's Decision No. 1159/QD-BTP dated May 23rd, 2018 regarding the functions, tasks, powers and organizational structure of the Department of Legal Dissemination and Education, the Department of Legal Dissemination and Education has the following functions, tasks, powers and organizational structure: I. Functions The Department of Legal Dissemination and Education (hereinafter referred to as the Department) is a department of the Ministry of Justice with the functions of advising and assisting the Minister in State administration of legal dissemination and education, local conciliation, improvement of law accessibility at communes, wards and towns. II. Tasks and powers The Department has the following tasks and powers: 1. Formulating and submitting the Department's long-term, five-year and annual work plans to the Minister; taking part in formulating Justice Sector's strategies, schemes and plans for long-term, five-year and yearly periods. 2. Leading and coordinating with relevant units to formulate and submit to the Minister strategies, schemes and policies regarding legal dissemination and education, local conciliation, improvement of law accessibility at communes, wards and towns. 3. Formulating legal normative documents projects and drafts and other programmes, schemes and documents within the Department's scope of responsibilities and submitting to the Minister or other authorised agencies for promulgation; participating in formulating, appraising, commenting on projects, draft documents within the Department's scope of responsibilities or as assigned by the Minister. 4. Formulating and submitting to the Minister to promulgate and providing guidance with the usage of legal dissemination and education documents; local conciliation and improvement of law accessibility at communes, wards and towns. 5. Leading the implementation of strategies, schemes, plans, programmes, policies, legal normative documents within the Department's scope of responsibilities. 6. Administrating law implementation and gathering information regarding the implementation of policies, strategies, legal normative documents and other documents within the Department's scope of responsibilities. 7. Reviewing, systemizing and consolidating legal normative documents and codifying legal norms systems within the Department's scope of responsibilities in accordance with law and Ministry's regulations. 8. In respect of legal dissemination and education work: a) Monitoring and providing technical assistance with legal dissemination and education work, as well as forming unit of officials carrying out the legal dissemination and education work, reporters and propagandists on legislation and people invited to participate in legal dissemination and education throughout the country; b) Advising and providing guidance with hosting Vietnam Law Day throughout the country; monitoring and reviewing the hosting of Vietnam Law Day by other Ministries, Ministry-level agencies, Governmental agencies, Provincial People Committees; organizing supporting activities for Vietnam Law Day at the Ministry of Justice; c) Assisting the Minister – President of the Central Council of Legal Dissemination and Education in carrying out the functions of the Standing Agency of the Council; d) Advising and submitting to the Minister to decide on the issue of acknowledgement and dismissal of legislation reporters in accordance with law; e) Monitoring, providing guidance and improving the formulation, management and utilisation of law libraries at communes, wards, towns, agencies, units, companies and schools; f) Monitoring and providing guidance for legal dissemination and education work within the Ministry's scope of responsibilities; leading or cooperating to organize legal dissemination and education activities for officials and staffs within the Ministry's scope of State administration. 9. In respect of local conciliation work: a) Leading and cooperating with other relating units under other Ministries, Ministry-level, Governmental agencies, Central Committee of the Vietnam Fatherland Front to provide guidance and directions and to review the local conciliation work; b) Providing technical assistance, making contents, programmes and organizing technical training for local conciliation and State administration regarding local conciliation in accordance with law and as assigned by the Ministry. 10. In respect of improvement of law accessibility at communes, wards and towns (hereinafter refer to as communes): a) Advising the Minister with providing guidance, monitoring and reviewing the improvement of law accessibility at communes in accordance with law; b) Formulating contents, programmes and organizing technical training for people responsible for the improvement of law accessibility at communes; c) Leading or cooperating with other units of the Ministry to monitor and review the implementation of law accessibility criteria and standards of the Ministry's scope of responsibilities; d) Combining the task of improving law accessibility at communes into poverty reduction programmes and National Target Programme regarding building modern rural area; e) Leading or cooperating to carry out other tasks included in National Target Programme regarding building modern rural area in accordance with law. 11. Advising and assisting the Minister with formulating and implementing commune regulations in accordance with law. 12. Leading or cooperating with other units of the Ministry and other relating agencies and organizations to draft and publish documents and prints (including newspaper, website and other Ministry's prints) regarding State administration of legal dissemination and education, local conciliation, improvement of law accessibility at communes. 13. Cooperating with other units of the Ministry of Finance with to monitor the fund administration and usage for legal dissemination and education, local conciliation, improvement of law accessibility at communes, benefits for reporters and propagandists on legislation, conciliators, people invited to participate in legal dissemination and education and people working with special subjects. 14. Organizing interim and final review to report about tasks and areas within the Department's scope of responsibilities. 15. Conducting international cooperation in areas within the Department's scope of responsibilities in accordance with law and as assigned by the Ministry. 16. Organizing or participating in reviews and inspections regarding law implementation within the Department's scope of responsibilities; fighting against corruption, negativity, wastefulness and violation; participating in denunciations and complaints settlement in accordance with law and as assigned by the Ministry. 17. Participating in scientific research, technical training and education in area within the Department's scope of responsibilities in accordance with law and as assigned by the Ministry. 18. Carrying out emulation and commendation works at the Department; cooperating with relevant agencies and organizations to monitor and propose commendations for groups and individuals with outstanding results in legal dissemination and education, local conciliation, improvement of law accessibility at communes, management and usage of law library works in accordance with law and as assigned by the Ministry. 19. Administrating Department's staff; managing and using assigned budget and assets in accordance with law and as assigned by the Ministry. 20. Carrying out other tasks and powers in accordance with law or as assigned by the Ministry.
