Workshop on implementation of Decree No. 59/2012/ND-CP dated 23/7/2012 of the Government on Monitoring Law Implementation

To prepare for the Decree’s implementation, with supports of Project “Strenthening Access to Justice and Protection of Rights in Viet Nam”, on 24/8/2012, the Ministry of Justice held a workshop on implementation of Decree No. 59/2012/ND-CP of the Government on Monitoring Law Implementation in Do Son, Hai Phong.

 

Deputy Minister of Justice, Le Thanh Long, chaired the workshop. Participated the workshop were representatives of Legal Department of the Government Office; legal units of ministries, ministerial agencies, Government’s agencies; General Department and Departments of the Ministry of Justice; Departments of Justice of some provinces and centrally-run cities in the North; Hai Phong’s Department of Justice, People’s Committee and Divisions of Justices.

At the workshop, representative of the Department of General Affairs of Legislative Development introduced basic contents of Decree No. 59/2012/ND-CP. Presented at the workshop were Mr. Tran Van Dat, Deputy Director General of the Department of General Affairs of Legislative Development, Ministry of Justice, introduced new contents of Decree No. 59/2012/ND-CP in comparison with Circular No. 03/2010/TT-BTP including: the Decree clear states the objectives of monitoring law implementation, which are to review and assess the practice of monitoring law implementation, recommend solutions for enhancement of the effectiveness of law implementation and improvement of the legal system (Article 3); supplement of the principles of monitoring law implementation, in which permit mobilization and participation of political organizations, socio-political organizations, socio-vocational organizations and the people in the process of monitoring law implementation (clause 5 Article 4). This principle was stipulated in numerous provisions of the Decree such as Article 6, 11, etc.

Moreover, Mr. Dat also introduced some key activities of the Ministry of Justice to implement Decree No. 59/2012/ND-CP such as organization of nationwide training courses, publication of a thematic issue of the Democratic and Law Journal on monitoring law implementation, providing a topic on the practice of monitorng law implementation on the Ministry’s website, etc. These are contents of the draft implementation plan of Decree No. 59/2012/ND-CP to be submitted to the Minister of Justice.

Related to implementation of Decree No. 59/2012/ND-CP, the Ministry of Justice also introduced the draft framework of monitoring law implementation at the workshop. This is initial study on the national statistical criteria system of monitoring law implementation conducted by the Ministry of Justice.

Thereafter, representatives of the Government Office, Supreme People’s Procuracy, Ministry of Industry and Trade, Ministry of Finance, Department of Justice of Bac Giang, Ha Giang province and Ha Noi, etc. shared opinions and information related to difficulties, challenges in monitoring law implementation, and comments on the draft framework and work plan of monitoring law implementation.

 

 

Deputy Minister Le Thanh Long believed that, in the coming time, with provisions prescribed in Decree No. 59/2012/ND-CP, the practice of lack of comprehensive and timely implementation of valid legal normative documents, and lack of consistency and accuracy in law implemenation by state agencies and competent persons, will be improved. It will, thus, improve the efficiency of law implementation, State and social management of State agencies. Deputy Minister Le Thanh Long suggested that legal departments of ministries, ministerial agencies, Government’s institutions, departments of justices of provinces and centrally-run cities, should play a more active role in  advising Ministers, heads of ministerial agencies and Government’s institutions, Chairman of People’s Committee of provinces and centrally-run cities in implementing Decree No. 59/2012/ND-CP once this Decree comes into force since 01 October 2012./.
