At the annoucement, Deputy Minister of Justice Tran Tien Dung presented the basic content of Law on Information Access.
With 5 chapters, 37 regulations, the Law on Information Access wiil be effective from July 1st 2018. Following the regulation in Article 25 of the 2013 Constituion, the Law regulated that the subject carrying the information access right is the people. Beside that, the Law also regulated to ensure the information access right of people with civil act ability loss, people with difficulty awareness and people under 18 years of age for them to access through their legal representatives.
For the foreigners in Vietnam under the protection of internaltional rules between countries or in return favour, the Law regulated that they are only allowed to request the information directly relate to their rights and obligations.
The Law regulated the sequences, procedures and deadlines provide information to ensure that the people are provided with information in a convient, quick and less expensive way. The organizations which was requested to provide the information have the responsibility to carry out the request in time with the procedures and deadlines according to the law.
No “hanging” law
To avoid the “hanging” situation because the lack of guiding Decrees, Circulars as the Law become effective, the Ministry of Justice are currently building law execution routes to report to the Prime Minister, issuing general plans to build guiding Decrees and Circulars.
According to the Deputy Minister, the Law regulated the obligations of State organizations in staff management, ensuring the people information access rights. The Ministry of Information and Communication will help the Government in technical guiding methods and information protection sequences missions. The most important aspect in operating this law is guarantee executing condition, information provider lead in order to complete the people requests in time.
