New stipulation on monitoring, examining and inspecting state-owned enterprises

On 20 May 2014, the Government issued Decree No. 49/2014/ND-CP providing for monitoring, examining and inspecting state-owned enterprises.

According to the Decree, the content of monitoring, examining and inspecting state-owned enterprises includes the observance of law on the following areas:

(1) Managing and using capital and state properties; the observance of financial regulations and supervision;

 (2) Arranging, innovating and strengthening the organization and operation of enterprises; developing and implementing strategies and plans for investment and development of production;

(3) Recruiting and managing employers; evaluating, rewarding and disciplining employers;

(4) The observance of provisions of specialized legal areas, technical regulations and procedures;

(5) The observance of provisions on supervision, examination and inspection of enterprises; evaluation and implementation of information processes of enterprises;

(6) Other provisions of the law at the request of owners or authorized state agencies.

In addition, the Decree clearly stated the content of monitoring, examining and inspecting the compliance of owners’ decisions. Such content includes the implementation of manufacturing strategies and plans, and approved developing investment plans; the activities of marketing, market development and technology; and recruiting, managing, evaluating, rewarding and disciplining employers.

The Decree comes into effect as from 10 July 2014.
