The Government issued Decree No. 48/2013/ND-CP dated 14/5/2013 amending and supplementing some articles of the Decree relating to administrative control.
Accordingly, the administrative control Department under the Ministry of Justice has the function to advise and assist the Minister of Justice shall perform the State management of the administrative control procedures.
The Administrative control Offices of legal organizations of Ministries, the ministerial agencies has function to advise and assist the head of the legal implementation of administrative control.
The Administrative control Offices of the Justice Departments has the function to advise and assist the Director of the Department of Justice implementing the administrative control procedures.
The Justice Minister shall specify the functions, tasks, powers and organizational structure of the Department of administrative control, in coordination with the Minister of Home Affairs guiding the functions, tasks , authority, organizational structure and staffing of the Department of administrative control of the legal departments under Ministries, ministerial-level agencies and the Departments of Justice.
The Justice Ministry give opinions on the administrative procedures specified in the project legal documents by the Government to the National Assembly, the National Assembly Standing Committee, draft legal documents issued under the authority of Government, the Prime Minister;
Legal departments of ministries, ministerial-level agencies give opinions on the administrative procedures specified in draft legal documents issued under the authority of the Minister, the ministerial leaders;
Departments of Justice give opinions on the administrative procedures specified in draft legal documents issued under the authority of the People's Committees of provinces and cities directly under central authority.
This Decree will take effect as from July 01, 2013.
