Execution procedure:

Persons who have been naturalized in Vietnam under Article 19 of Law on Vietnamese citizenship, regardless of whether they reside inside or outside the Vietnamese territory, may be deprived of Vietnamese citizenship, if they carrying out activities that seriously endanger national independence and the cause of building and defending the Socialist Republic of Vietnam, or to the interests and prestige of the Socialist Republic of Vietnam.

Within 15 days after the date of detecting or receiving a complaint or denunciation about an act that cause serious harms to the national independence, and the cause of building and defending of the Socialist Republic of Vietnam, or to the interests and prestige of the Socialist Republic of Vietnam the provincial-level People’s Committee or overseas Vietnamese representative mission shall conduct verification, if obtaining sufficient grounds, it shall compile a dossier to propose the President to deprive the person committing such act of his/her Vietnamese citizenship.

 Courts which have adjudicated persons committing acts that cause serious harms to national independence and the cause of building and defending the Socialist Republic of Vietnam, or to the interests and prestige of the Socialist Republic of Vietnam shall compile a dossier to propose the President to deprive these persons of their Vietnamese citizenship.

Execution Method:  A person applying for Vietnamese citizenship shall file a dossier to the Justice Department of the locality where he/she resides

Dossier content:

In case a provincial-level People’s Committee or an overseas Vietnamese representative mission proposes the deprivation of Vietnamese citizenship of persons who commit acts defined in Clause 1, Article 31 of the Law on Vietnamese citizenship, a dossier : 

-  The written proposal for deprivation of Vietnamese citizenship, made by the provincial-level People’s Committee or overseas Vietnamese representative mission;

-  Verification documents and conclusions of competent agencies about the act committed by the person proposed for deprivation of Vietnamese citizenship;

-  Written denunciation against the person proposed for deprivation of Vietnamese citizenship (if any)

 In case courts which have adjudicated persons for acts defined in Clause 1, Article 31 of the Law on Vietnamese citizenship propose the deprivation of Vietnamese citizenship of these persons, a dossier comprises:

- The court’s written proposal for deprivation of Vietnamese citizenship;

- The legally effective judgment and relevant document

Time of execution: 65 days ( actual execution time at the relevant authorities)

Authority of administrative procedure execution: provincial-level People’s Committee
